1. Acceptance of Terms

By accessing, browsing, or using the Southern African Endurance Series (“SAES”) website, you accept and agree to be bound by these Terms & Conditions. If you do not agree with these terms, please stop using the website immediately.

2. About Us

he Southern African Endurance Series (SAES) operates a motorsport championship across South Africa and neighbouring territories. References to “SAES”, “we”, “our”, or “us” refer to the custodians of this website.

3. Permitted Website Use

You may only use this website for lawful purposes. You may not:

  • Copy or commercially exploit website content without written consent

  • Interfere with security, operations, or access controls

  • Upload harmful, defamatory, or illegal content

  • Submit false information, fraudulent entries, or impersonate others

4. Accuracy of Information

SAES strives to ensure that information is correct, but cannot guarantee that event dates, pricing, entries, or regulations will remain unchanged, or that content is error-free, current, or uninterrupted. We reserve the right to amend or remove content at any time.

5. Event Changes & Cancellations

All motorsport activities are subject to weather, safety, venue control, or Motorsport South Africa (MSA) decisions. SAES may postpone, move, or cancel events without prior notice. Ticketing and entry fee policies are defined under payment and cancellation clauses.

6. Intellectual Property

All images, text, graphics, videos, logos, race content, software, and branding on this website are owned by SAES or licensed third parties. No material may be copied, modified, reposted, or redistributed without written permission.

7. User Submissions

If you submit content (including text, photos, media, comments, logos, or team information), you confirm that you own the rights to the content and that it does not infringe third-party rights. You grant SAES a non-exclusive, royalty-free licence to publish and edit submissions for promotional and administrative use.

8. Driver & Team Profiles / Image Usage

Teams and drivers submitting entries, media, or profiles grant SAES permission to display names, photos, car liveries, team information, standings, and race features, and to use imagery submitted or captured at events for promotional, archival, and marketing purposes. Entrants must ensure they hold rights to sponsor logos and affiliated artwork.

9. Sponsorship Listings & Obligations

Where teams list sponsors on an SAES platform, sponsor details must be accurate and supplied with permission. SAES may remove sponsors that conflict with legal, ethical, commercial, or MSA restrictions. SAES is not responsible for financial arrangements or disputes between sponsors and teams.

10. Media, Image & Data Consent

Media accreditation is granted at SAES discretion. MSA-accredited media personnel must register via the official accreditation link, report to Documentation on arrival, and comply with Clerk of the Course instructions.

Competitors grant SAES the right to use names, car numbers, nationalities, sponsor logos, images, race data, results, livestreams, and performance statistics across event reports, broadcasts, social media, sponsorship material, and historical records. No royalties or payments will be due.

10.1 Licence Grant

Accredited media grant SAES the right to use captured photos and videos for archives, marketing, editorial reporting, and social media, with credit where practical.

10.2 Restrictions

Media may not sell event material commercially without permission, misrepresent SAES, publish defamatory content, or use SAES branding without authorisation.

10.3 Safety

Media must comply with MSA access protocols, official instructions, barriers, and circuit safety requirements. Non-compliance may result in revocation of credentials.

11. Privacy & POPIA Compliance

SAES processes personal information in accordance with the Protection of Personal Information Act (POPIA). Users may request access, correction, or deletion of data where legally permissible. Full details are provided in Part B of this document.

12. Cookies & Tracking

The website uses cookies to enhance functionality and analyse visitor usage. Disabling cookies may affect site performance.

13. Ticketing, Membership & Online Store

Where SAES sells merchandise, tickets, or membership access, transactions are conducted at the user’s own risk.

13.1 Pricing

Prices are quoted in South African Rand unless otherwise stated and may change without notice.

13.2 Payments

Payments are processed through secure third-party platforms. SAES does not store credit card details.

13.3 Confirmation

A purchase is binding once full payment is received.

14. Returns, Refunds & Cancellations

14.1 Merchandise

In accordance with the Consumer Protection Act (CPA), damaged or defective items may be returned within 7 days. Returned items must be unused unless faulty and in original packaging.

14.2 Tickets & Race Entries

Unless explicitly stated, tickets and race entries are non-refundable. Postponed events will be rolled forward to a replacement date. Refunds will not apply for weather disruptions, no-shows, disqualification, or team withdrawal.

14.3 Digital Goods

Digital downloads are final sale unless defective or inaccessible due to SAES error.

15. Third-Party Links

SAES is not responsible for the content or privacy practices of external websites linked from this site.

16. Disclaimers

Motorsport is inherently dangerous. Website content is provided “as is” without warranties and does not constitute legal or professional advice.

17. Limitation of Liability

SAES will not be held liable for losses arising from event changes, injuries, damages, website downtime, data errors, or actions of third-party service providers. Participation in motorsport activities is entirely at your own risk.

18. Indemnity

You agree to indemnify SAES, its owners, staff, volunteers, officials, partners, sponsors, and Motorsport South Africa (MSA) against all claims, losses, injuries, expenses, and damages arising from motorsport participation, website misuse, or breach of these terms.

These terms are governed by the laws of the Republic of South Africa. Disputes shall be adjudicated in South African courts.

20. Changes to Terms

SAES may revise these Terms & Conditions at any time. Continued use of the website indicates acceptance of updated terms.

21. Insurance

Entrants acknowledge that personal accident, vehicle damage, and liability insurance remain the responsibility of the competitor, entrant, team, parent, or guardian. SAES bears no obligation for repair, medical, or recovery costs.

By attending any SAES event you grant the promoters and media representatives the right to capture your image, voice and likeness. These materials may be used for marketing, promotional and archival purposes, including but not limited to social media, websites, print publications and future event promotions.
